Josef Drexl How Can the Data Economy Be Regulated to Promote New Emerging Markets?
Josef Drexl is Director of the Max Planck Institute for Innovation and Competition. He is also Honorary Professor at the Ludwig Maximilian University Munich, Member of the Bavarian Academy of Sciences and Humanities, and Chair of the Project Coordination Board of the Munich Intellectual Property Law Center (MIPLC). As visiting professor, he taught at Oxford University, the Libera Università Internazionale per gli Studi Sociali Guido Carli in Rome, New York University and the Université de Paris 2 Panthéon-Assas. His current research focus is on intellectual property and competition-law issues of the new digital economy. He served as founding chair of the Academic Society for Competition Law from 2003 to 2013 and he is a vice-president of the Association Internationale de Droit Economique.

Max Planck Institute for Innovation and Competition
The Max Planck Institute for Innovation and Competition was founded in Munich in 1966 as the Institute for Foreign and International Patent, Copyright and Competition Law. During the following decades, it became instrumental in the development of the areas of law that it dealt with. In 2002, in conjunction with new appointments, its scope of research was extended to include core areas of antitrust law and tax law - hence, the change of the Institute’s name to the Max Planck Institute for Intellectual Property, Competition and Tax Law. After the establishment of an additional department for financial economics in 2008, this Institute was replaced, with effect from January 1, 2011, by the MPI for Intellectual Property and Competition Law and the MPI for Tax Law and Public Finance. Together with the MPI for Foreign and International Social Law, these two Institutes form the Munich-based Max Planck Campus for Legal and Economic Research. In 2013, the Max Planck Institute for Intellectual Property and Competition Law was expanded to include a new, economics-oriented department (Innovation and Entrepreneurship Research); in 2014 the Institute changed its name to Max Planck Institute for Innovation and Competition. In the new digital economy the problem of data protection is not only heatedly debated but also has become the subject of academic research. New business models are emerging based on the current digital transformation of manufacturing and the digital transformation of many smart products. These smart products, such as autonomous cars, collect a huge number of data. The question arises: Who owns the data and how should the access to these data be regulated? JOSEF DREXL is interested in the future regulation of the data economy and explores the question of how we can generate or enable markets to emerge that are built on the use of data. As he explains in this video, his research group suggests – based on their analysis of the workings of the market – that the concept of ownership is not needed in this context and that a targeted access to property rights should be introduced into the regulations.
